Today Obama passed the Dream Act without having a vote in Congress.
Obama has zero authority to do this. The president does not make law. If the president makes law, this is a monarchy/dictatorship. The president is in charge of executing the laws, not making them or adjudicating them. If the executive sucks in the power of the other 2 branches, then we are a dictatorship. Obama has repeatedly bypassed both law and judges.
Bypassing Legislature:
- "Czars" are his shadow cabinet which he put in place to bypass the constitutional requirement that his cabinet is approved by the Senate
- Illegal Immigrants legalized today
- Ruled Churches had to implement support for Abortion drugs, with no legislation backing that up.
- Legislation allows the Executive's Environmental
protection agency to regulate pollutants. Law is designed to regulate hard chemicals. EPA enacted a new rule that says that Carbon Dioxide is a pollutant. Since 100% of people and businesses use carbon Dioxide, they essentially expanded their power from regulating harmful substances to absolute power to regulate everything. - War Powers Act - President is required to get congressional authorization within 60 days of committing the US to war in any country. He went into Libya and stayed there longer than that and never even bothered to submit a notification, let alone, get approval.
Bypass the Judiciary
- President Put in place temporary Moratorium on drilling in the gulf after BP oil spill. After spill was cleaned up oil companies sued to reopen the Moratorium . Judge ruled the administration didn't have the right to keep the Moratorium in place. They did it anyway. Companies sued 4x and won all 4 cases, but the administration refuses to comply with the courts
- Bypass Bankruptcy Laws, which are normally implemented by courts, to give Chrysler stock to the Auto Workers Union and shut out the bond holders who had first claim.
Bypassing the States
- Government forbid Boeing to build a factory in South Carolina because it declared that Boeing was doing so to get around labor laws in Washington state. If the federal government can tell one state that it should have the laws of another state, then why have states? The states become meaningless as independent entities, entitled to make their own laws.
- Nationalized State Expenditures - States are independent, allowing one state to be frugal and another spendthrift. This is a check on states because they face competition from other states. But if the federal government pulls in money from all states and then spends them on other states, then this control is bypassed, as is the control on the federal gov't itself. Where does Obama get money to send money to CA to hire teachers, cops and firemen? From taxes levied in other states! States which didn't piss away all their money on unions, thus will be sending money to CA unions, who in turn pay Obama.
In addition, the democratic legislature has bypassed it's own rule to pass legislation when it didn't have the votes.
- Obamacare passed the Senate without the required 60 votes via a complex scheme to re categorize the bill as a type of bill that would only need 50 votes.
I'm sure there's tons more. This is just off the top of my head.
